McKinnon appeal refused | | 2008/08/28 | |
Gary McKinnon's appeal against his extradition to the US to face charges of computer hacking has been refused by the European court of human rights.
Previously, the court had decided that his extradition was to be delayed until midnight on Friday to process his request but they have brought their decision forward and have refused Mr McKinnon's request, Tech World reports.
The UK hacker is accused of breaking into systems belonging to NASA and American military websites and had sought exemption from extradition using Article Three of the European Convention of Human Rights, claiming that US detention conditions would breach Euro standards.
McKinnon's solicitor Kaim Todner pointed out that the crimes his client is accused of were allegedly committed in the UK and said: "We maintain that any prosecution of our client ought therefore to be carried out by the appropriate British authorities."
A US court first indicted McKinnon in 2002 for crimes perpetrated in 2001 but it wasn't until 2005 when UK police arrested him.
Graham Cluley of security firm Sophos said that the development sent a clear warning to anyone considering a similar action.
He said: "The message is clear - if you hack into computers you have to realise that the legal consequences could be severe." |
