Public support grows for McKinnon | | 2008/09/02 | | Last week's decision by the European Court of Human Rights to ignore the pleas of Gary McKinnon's solicitors to have him tried in the UK prompted a peaceful demonstration outside the Home Office.
The possibility of McKinnon being extradited could lead to his incarceration for 70 years and fines worth millions of pounds.
McKinnon's solicitor Karen Todner has told the Home Office that removing him from the UK would be a breach of his human rights despite last week's ruling and the Home Office is said to be considering the claim.
Ms Todner is maintaining that the punishment McKinnon can expect in the US is likely to be disproportionate to McKinnon's hacking activities, VNU Net reports.
She said: "Under the UK system he would face three to four years in prison while over there it could run into decades in a super maximum prison.
"If he is extradited I would expect the UK government to request diplomatic assurance, meaning that he would serve his sentence over here."
She went on to say that McKinnon's condition - he suffers from Asperger's Syndrome - should also be taken into account.
The hacker first breached sensitive US websites in 2001 and left messages which questioned the extraordinary state of homeland security during the 9/11 attacks but has since maintained that he was looking for information on UFOs. |
